The terms governing your access to and use of CRiskCo services.

These Terms of Service (the "Terms") govern your access to and use of the website, software, APIs, onboarding flows, dashboards, reports, credit intelligence tools, data processing services, monitoring services, analytical models, and related services provided by CRiskCo Inc. ("CRiskCo", "we", "us", or "our").
By accessing or using our website or Services, creating an account, completing an onboarding flow, submitting information, authorizing access to SAT or another authorized source, or using CRiskCo through a financial institution, lender, fintech, credit provider, customer, or partner, you agree to these Terms.
If you are using the Services on behalf of a company or other legal entity, you represent that you have authority to bind that company or legal entity to these Terms.
1. Who We Are
This website and the CRiskCo platform are operated by CRiskCo Inc. Our registered Federal Employer Identification Number is 47-3094377 and our registered address is 1420 York Ave, New York, NY 10021, USA.
CRiskCo provides credit intelligence, business risk analysis, data processing, monitoring, reporting, scoring, APIs, software, and related services for companies, financial institutions, lenders, fintech companies, credit providers, and other business customers.
2. Definitions
For purposes of these Terms:
"Services" means CRiskCo's website, software, APIs, onboarding flows, dashboards, reports, models, scores, alerts, monitoring tools, data processing services, credit intelligence services, and related products or services.
"User" means any person or entity that accesses or uses the Services, including applicants, companies, customers, partners, authorized users, and representatives.
"Customer" means any institution, company, partner, lender, fintech, credit provider, or other business that contracts with CRiskCo or uses CRiskCo Services.
"Applicant" means a company, business owner, legal representative, guarantor, obligor, shareholder, beneficial owner, or other person or entity whose information is submitted to, accessed by, or processed through the Services.
"Customer Data" means information, documents, credentials, authorizations, records, files, instructions, or other data provided to CRiskCo by or on behalf of a User, Customer, Applicant, or authorized third party.
"Authorized Sources" means SAT, tax authorities, accounting firms, public databases, customer-provided sources, partner-provided sources, regulatory sources, third-party data providers, or other sources accessed with authorization, under contract, or as permitted by applicable law.
"Outputs" means any scores, reports, alerts, dashboards, insights, indicators, benchmarks, model results, risk signals, recommendations, classifications, analyses, or other results generated by or through the Services.
3. Use of the Services
Subject to your compliance with these Terms, CRiskCo grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for lawful business purposes and in accordance with these Terms, the applicable order form, agreement, documentation, or onboarding authorization.
You agree that:
- You will use the Services only for lawful business purposes.
- You will provide accurate, current, complete, and lawful information.
- You have all rights, authority, permissions, and consents required to submit information or authorize access to information.
- You will not use the Services to violate any law, regulation, third-party right, contractual obligation, privacy obligation, or confidentiality obligation.
- You will not interfere with, disrupt, reverse engineer, scrape, copy, resell, abuse, or attempt to gain unauthorized access to the Services.
- You will keep usernames, passwords, credentials, tokens, and access methods confidential and secure.
- You are responsible for all activity that occurs through your account, credentials, or authorized access.
4. Data, Privacy, and Authorization
Your use of the Services is subject to our Privacy Policy, which explains how CRiskCo may collect, access, receive, consult, process, analyze, use, store, protect, share, retain, aggregate, derive, disassociate, anonymize, and otherwise handle information.
By using the Services, submitting information, completing an onboarding flow, authorizing access to SAT or another Authorized Source, or using CRiskCo through a Customer, partner, financial institution, lender, fintech, or credit provider, you authorize CRiskCo to access, receive, consult, process, analyze, store, and use tax, financial, commercial, transactional, operational, and related information for the purposes described in the Privacy Policy and in these Terms.
These purposes may include:
- Financial analysis.
- Credit evaluation and credit intelligence.
- Risk analysis and risk prevention.
- Fraud prevention and validation.
- Business verification and compliance review.
- Monitoring, alerts, and reporting.
- Generation of scores, reports, dashboards, indicators, and analytical outputs.
- Delivery of results to the Customer, institution, partner, or entity with which you are submitting an application or maintaining a business relationship.
- Operation, support, security, maintenance, and improvement of the Services.
- Model development, training, validation, calibration, monitoring, updating, and improvement, including FinScore and other CRiskCo models.
- Statistical analysis, benchmarking, market analysis, sector analysis, portfolio insights, product development, and business intelligence.
- Compliance with legal, regulatory, audit, contractual, tax, accounting, security, and operational obligations.
You are responsible for ensuring that any information, credentials, authorization, consent, or access you provide to CRiskCo is accurate, valid, current, lawful, and provided with all required rights and permissions.
5. Aggregated, Derived, Disassociated, and Anonymized Information
CRiskCo may generate, use, share, license, or commercialize aggregated, statistical, derived, disassociated, or anonymized information, provided that such information does not identify and cannot reasonably be used to identify you, your company, your legal representatives, shareholders, customers, suppliers, employees, guarantors, obligors, beneficial owners, or other related persons.
CRiskCo does not sell identifiable personal information or identifiable company-specific commercial information except where authorized, required by law, required by contract, or otherwise permitted under an applicable legal basis.
6. Customer Data and Responsibility
As between you and CRiskCo, you retain any rights you have in Customer Data that you submit or authorize for processing, subject to the rights granted to CRiskCo under these Terms, the Privacy Policy, and any applicable agreement.
You are solely responsible for the legality, accuracy, quality, integrity, reliability, and completeness of Customer Data and for obtaining all rights, authorizations, and consents required for CRiskCo to process such data.
CRiskCo is not responsible for errors, omissions, delays, inaccuracies, incompleteness, or unavailability caused by Customer Data, third-party systems, Authorized Sources, user credentials, expired authorizations, system limitations, or information that is unavailable, incorrect, incomplete, outdated, or inaccessible.
7. Credit Analysis, Scores, and No Financing Guarantee
CRiskCo provides credit intelligence, data processing, validation, analytics, monitoring, scoring, reporting, and related technology services.
CRiskCo is not a lender and does not provide loans, credit facilities, financing, guarantees, or financial commitments to Applicants.
Any CRiskCo score, report, alert, dashboard, model output, recommendation, insight, or analysis is provided as a decision-support tool only. CRiskCo does not guarantee the accuracy, completeness, approval, rejection, pricing, terms, availability, or outcome of any credit, financing, commercial, compliance, or risk decision.
The final decision regarding any credit application, financing request, commercial relationship, risk action, or business decision belongs solely to the financial institution, lender, fintech, credit provider, Customer, partner, or other entity using the Services, based on its own policies, criteria, judgment, and applicable law.
The Services depend on the information available at the time of processing, the sources accessed, the authorizations granted, the quality of the underlying data, and the configuration of the relevant service or model. CRiskCo does not guarantee that all information will be complete, current, error-free, available, or sufficient for any specific decision.
8. No Professional Advice
The Services, Outputs, reports, scores, models, indicators, and insights are provided for informational and decision-support purposes only.
CRiskCo does not provide legal, tax, accounting, investment, financial advisory, underwriting, lending, or regulatory advice through the Services. You are responsible for making your own decisions and for obtaining professional advice where appropriate.
9. Accounts and Security
You are responsible for maintaining the confidentiality of your account, credentials, passwords, tokens, API keys, and access methods.
You agree to notify CRiskCo promptly if you become aware of any unauthorized access, credential compromise, security incident, or misuse of the Services.
CRiskCo may suspend or restrict access to the Services if we reasonably believe there is unauthorized access, misuse, security risk, legal risk, violation of these Terms, or risk to CRiskCo, our Customers, partners, Applicants, systems, or data.
10. Third-Party Services and Authorized Sources
The Services may depend on or integrate with SAT, tax authorities, public sources, private sources, accounting firms, cloud providers, data providers, identity providers, communication providers, payment processors, or other third-party systems.
CRiskCo does not control third-party systems and is not responsible for their availability, accuracy, performance, security, policies, delays, errors, outages, or changes.
Access to third-party or Authorized Sources may depend on credentials, authorizations, APIs, system availability, technical restrictions, legal requirements, or third-party policies.
11. Fees and Payment
Certain Services may be provided for a fee. Fees, payment terms, taxes, billing periods, renewal terms, usage limits, and cancellation terms may be described in an order form, proposal, invoice, agreement, pricing page, or other written arrangement between you and CRiskCo.
Unless otherwise stated in writing, fees are non-cancelable and non-refundable, and taxes are not included.
You are responsible for paying all applicable taxes, duties, withholdings, bank fees, currency conversion fees, and similar charges related to your use of paid Services.
12. Intellectual Property
CRiskCo and its licensors retain all rights, title, and interest in and to the Services, software, APIs, models, algorithms, workflows, databases, documentation, designs, reports, formats, dashboards, trademarks, trade names, logos, technology, know-how, and other intellectual property.
These Terms do not transfer any ownership rights to you.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, attempt to extract source code, create derivative works from, or otherwise exploit any part of the Services except as expressly permitted in writing by CRiskCo.
CRiskCo may use feedback, suggestions, ideas, or recommendations you provide without restriction or obligation to you.
13. Confidentiality
You may receive or access non-public information related to CRiskCo, the Services, Customers, Applicants, models, technology, pricing, documentation, business operations, security controls, or other confidential information.
You agree to protect confidential information with reasonable care and to use it only for the purpose of using the Services as authorized.
This obligation does not apply to information that is publicly available through no fault of yours, independently developed without use of confidential information, or lawfully received from a third party without confidentiality obligations.
14. Service Availability and Changes
CRiskCo may update, modify, suspend, replace, discontinue, or limit any part of the Services from time to time.
We may perform maintenance, updates, security changes, infrastructure changes, or product improvements that affect availability or functionality.
CRiskCo does not guarantee uninterrupted, error-free, or continuous availability of the Services unless expressly agreed in a separate written service-level agreement.
15. Disclaimers
To the fullest extent permitted by applicable law, the Services and Outputs are provided on an "as is" and "as available" basis.
CRiskCo disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, reliability, and suitability for any particular decision or outcome.
CRiskCo does not guarantee that the Services will be uninterrupted, secure, error-free, free of harmful components, or that any information, report, score, model output, or insight will be complete, accurate, current, or suitable for your intended use.
16. Indemnification
You agree to defend, indemnify, and hold harmless CRiskCo, its affiliates, subsidiaries, officers, directors, employees, contractors, agents, licensors, and partners from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your use or misuse of the Services.
- Your violation of these Terms.
- Your violation of applicable law or third-party rights.
- Customer Data or information you provide, submit, or authorize for processing.
- Any failure to obtain required consents, authorizations, rights, or permissions.
- Any decision, action, or omission based on the Services or Outputs.
17. Limitation of Liability
To the fullest extent permitted by applicable law, CRiskCo will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, revenue, business, goodwill, data, use, or opportunities, even if CRiskCo has been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, CRiskCo's total aggregate liability arising out of or related to the Services or these Terms will not exceed the fees paid by you to CRiskCo for the Services giving rise to the claim during the twelve months immediately preceding the event giving rise to liability.
If you have not paid fees to CRiskCo during that period, CRiskCo's total aggregate liability will not exceed USD $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
18. Termination and Data Retention
You may stop using the Services at any time. CRiskCo may suspend or terminate access to the Services if you violate these Terms, create legal or security risk, fail to pay amounts due, misuse the Services, or if continued access may harm CRiskCo, our Customers, partners, Applicants, systems, or data.
Upon termination or cancellation of an account or Service, your right to access and use the Services will end.
CRiskCo may delete, block, retain, aggregate, derive, disassociate, anonymize, or continue processing information as described in the Privacy Policy and as permitted or required by applicable law, contract, regulatory obligation, audit requirement, tax or accounting obligation, security need, dispute resolution, model improvement, or legitimate business purpose.
Termination does not affect rights, obligations, authorizations, limitations of liability, confidentiality obligations, payment obligations, intellectual property rights, data rights, or other provisions that by their nature should survive termination.
19. Force Majeure
CRiskCo will not be responsible for delay, failure, interruption, or unavailability caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, government actions, internet or telecommunications failures, cloud provider outages, third-party system failures, cyberattacks, power failures, pandemics, regulatory changes, or failures of Authorized Sources.
20. Changes to These Terms
CRiskCo may update these Terms from time to time to reflect changes in our Services, business, technology, legal requirements, or operational practices.
The updated Terms will be posted on this page with the "Last updated" date. Continued use of the Services after the updated Terms become effective means you accept the updated Terms.
Where required by law or contract, we may provide additional notice or request additional consent.
21. Governing Law
These Terms and any dispute arising out of or related to these Terms or the Services will be governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, unless applicable law requires otherwise.
You agree that any dispute arising out of or related to these Terms or the Services will be subject to the courts located in Delaware, USA, unless otherwise required by applicable law or agreed in a separate written agreement.
22. Order Forms and Separate Agreements
If you have entered into a separate written agreement, order form, statement of work, data processing agreement, service-level agreement, or other contract with CRiskCo, that agreement will control to the extent it expressly conflicts with these Terms.
These Terms apply to the extent not replaced or modified by a separate written agreement.
