What it is and how it works
When a bank opens an account for a legal entity, AML regulation requires identifying the beneficial owner: any natural person with a direct or indirect participation of 25% or more in share capital or voting rights. If no individual reaches that threshold, the institution may register a designated figure (sole administrator, legal representative, or other) as the fictitious beneficial owner, and the client signs a single sworn declaration attesting to it. CRiskCo Verify delivers this identification by querying official sources from the RFC alone — no CIEC and no taxpayer signature. It also covers the CFF Article 32-B Ter obligation (Beneficiario Controlador).
Use cases
- Bank account opening: beneficial owner identification
- AML compliance with 25% direct and indirect threshold
- KYB onboarding for clients and suppliers
- Fictitious beneficial owner documentation via single sworn declaration
- CFF Article 32-B Ter compliance (Beneficiario Controlador)
- Pre-credit due diligence
